Creator Terms

Creator Terms.
For individual creators.

Last updated · October 2026Plain language. No fine print.

These Creator Terms are a contract between you, as an individual content creator, and OPTIMATOR SRL, a company incorporated under the laws of Romania, with registered office at Str. Nerva Traian 27-33, Sc. B, Et. 1, Ap. BIR. 6, Sector 3, Bucharest, Romania, Trade Register No. J2025062435003, CUI 52353277, represented by Eusebiu Ionescu Marian, Administrator ("Optimator," "we," "us"). They apply when you create a creator account, accept a collaboration, attend a visit, or post content through Optimator. They are not the business Terms of Service. If you are a business buying Optimator's services, those terms at https://optimator.ai/terms apply to you instead.

01Who this covers

Who this covers

These Creator Terms cover you as a natural person acting as a creator (an influencer), not as a company buying a subscription. You and Optimator are independent parties. Nothing here makes you an employee, partner, or agent of Optimator or of a business.

By creating a creator account, ticking the acceptance box, or taking part in a collaboration, you agree to these Creator Terms and to the Privacy Policy at https://optimator.ai/privacy.

We may update these Creator Terms. The current version is published at this page with the date above. If a change is material, we will ask you to accept it again before you take a new collaboration. If you do not agree, do not take new collaborations. Collaborations you already confirmed stay on the terms you accepted for them, plus any change the law requires.

02Eligibility

Eligibility

You must be at least 18 years old and able to enter a contract. Optimator does not accept creators under 18.

You sign up for yourself. If you later work through a company or manager, you still remain responsible for what you post and for showing up to visits you confirmed.

03Your profile and audience

Your profile and audience

The profile, handle, city, and audience information you give Optimator and businesses must be accurate and kept up to date.

Your accounts and followers must be genuine. Do not buy followers, likes, comments, or views, and do not use bots or other fake engagement to qualify for collaborations. We may refuse or suspend an account that misstates its audience.

04Visits

Visits

When you and a business confirm a visit, you will attend at the agreed time and follow the house rules that were shown before you confirmed.

If you cannot attend, cancel or ask to reschedule in the product before the visit, with as much notice as you can, and in any case before the visit time. Do not simply fail to appear.

Treat the business and its staff with the same courtesy you would expect as a guest. The meal, product, or other in-kind benefit (the "Comp") is the compensation for the collaboration. It is not a gift you may take without posting, and it is not something you re-sell.

05The post

The post

You will publish the content you agreed (the format, tags, and mentions the brief names) within five (5) business days after the visit, unless the brief gives a different deadline.

You will submit proof that the post is live, in the way Optimator asks (for example a link or a screenshot).

You will keep the post live and unaltered in its substance for at least twelve (12) months from the day it goes live. You may remove it sooner if the law, a platform, or a safety issue requires it. Tell Optimator if you take it down.

Use the tags, mentions, and disclosures the brief requires. A missing required mention is a missed post until you correct it.

06Honesty and disclosure

Honesty and disclosure

Say what you actually experienced. Do not invent a visit, a result, or a review. Do not post fake reviews or hide honest criticism because a business asked you to.

Tell people the collaboration is sponsored. Follow EU law, Romanian advertising and consumer rules, and the rules of the platform you post on. Where a label is required, use a clear one such as "ad" or "sponsored" in the caption or the platform's paid-partnership tool, not buried in a pile of hashtags.

07If you miss the visit or the post

If you miss the visit or the post

If you confirm a visit and do not attend, or you attend and do not post as agreed, Optimator may suspend or close your creator account and stop offering you collaborations.

We may also ask you to reimburse the business for the reasonable value of the Comp you received or that was held for you. That value is what the business normally charges a paying guest for the same meal or product, unless a different amount was stated before you confirmed.

A suspension decision will be sent to the email on your account. You may reply with an explanation. We will review it in good faith. Mandatory rights you have under Romanian or EU law are not reduced by this section.

08Ownership and license

Ownership and license

You keep ownership of the content you create.

You grant Optimator and the business a non-exclusive, royalty-free, worldwide license to use that content for organic promotion: reposting on Optimator's channels and on the business's own channels, including in the product, in onboarding, and in case studies that show the collaboration, with credit to you where the format allows.

That license does not include paid ads, whitelisting, boosting, or spark ads. Paid use needs a separate written agreement with you. Organic use under this section does not require a separate fee.

You promise that your content is yours to license, and that it does not infringe someone else's rights or include a person who has not agreed to be in it, except for incidental people in a public place where the law allows.

09Money

Money

On the standard collaboration, your compensation is the Comp from the business, not a cash fee from Optimator. Do not ask the business for a side payment, tip, freebie, or invoice outside Optimator for that collaboration, and do not accept one if it is offered.

If a collaboration includes a cash fee, it will be stated in writing before you confirm, and it is paid only through Optimator. Anything else is outside these terms.

10Platforms

Platforms

You are responsible for following the terms of the platforms you use, including Instagram, TikTok, and other Meta products. A platform suspension, removed post, or limit on your account does not remove your duties for visits you already confirmed, except where performing them would break the law or that platform's rules. Tell us promptly if a platform removes the post.

11Privacy

Privacy

Optimator handles your personal data as described in the Privacy Policy at https://optimator.ai/privacy. We share what a business needs in order to host the visit and check the post (for example your name, handle, and the time you booked). We do not sell your profile.

You may ask us about your data at support@optimator.ai. Mandatory rights under the GDPR and Romanian data-protection law apply.

12Ending this arrangement

Ending this arrangement

You may stop using your creator account at any time by writing to support@optimator.ai. Visits you have already confirmed, posts you still owe, and the license for content you already published stay in place.

We may suspend or close the account if you break these Creator Terms, if we reasonably believe your audience is not genuine, or if we stop offering creator collaborations. We will tell you by email when we do.

13Liability

Liability

Optimator provides the introduction, the account, and the scheduling tools. The business is responsible for the Comp, the premises, and how its staff treat you. You are responsible for your content and for getting yourself to the visit.

To the maximum extent the law allows, Optimator is not liable for indirect or consequential loss, lost followers, or lost income. Optimator's total liability to you for a claim about a collaboration is limited to the greater of (a) the cash Optimator actually paid you for that collaboration in the three (3) months before the claim, or (b) one hundred euros (EUR 100).

Nothing in these Creator Terms limits liability that cannot be limited under Romanian or EU law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence. If you are a consumer, mandatory consumer rights stay in place.

14Law and disputes

Law and disputes

These Creator Terms are governed by the laws of Romania. The courts of Bucharest, Romania have jurisdiction, except where a mandatory consumer rule gives you the right to sue or be sued in the courts of your home country.

Write to support@optimator.ai before you start a formal claim, and give us thirty (30) days to try to resolve it. This does not block you from using an out-of-court consumer body or a procedure the law says you may use immediately.
